Terms of sale
1. The agreement
The agreement consists of these terms of sale, the details in your order and any terms agreed separately. If they conflict, what was agreed separately takes precedence over these terms. The purchase is otherwise governed by the Norwegian Consumer Purchases Act (forbrukerkjøpsloven), the Cancellation Act (angrerettloven) and the E-Commerce Act (e-handelsloven).
2. The parties
The seller is Nektar Import AS, org. no. 935234506, Fredensborgveien 30B, 0177 Oslo, Norway. Email: post@nektarimport.no. Phone: +47 95298527. The buyer is the consumer placing the order.
3. Price
The price of the item is shown on the website and includes VAT. If you pick up the item from us, there are no extra costs. Sending by post costs NOK 65. The total price is shown in Vipps before you pay.
4. Ordering and payment
The agreement is binding once you have approved the payment in Vipps. You pay with Vipps, and the amount is charged once you have approved the payment. You will find the receipt in the Vipps app. If there is an obvious typing error in the price, the agreement is not binding on either party.
5. Delivery
You choose whether to pick up the item from us at Fredensborgveien 30B, 0177 Oslo, or have it sent by post. We normally send the item within five working days. If you choose pickup, the item is ready once you have received your receipt. The item is delivered when you have picked it up, or when it has arrived at the address you gave. The risk for the item passes to you once it is delivered.
6. Right of withdrawal
You can cancel the purchase without giving a reason within 14 days of receiving the item. Let us know by email within the deadline, for example using the standard cancellation form. We refund what you have paid, including the cost of sending the item to you, no later than 14 days after we received your notice. We may wait to refund you until we have received the item back.
7. Returns
Send or bring the item back to us without undue delay, and no later than 14 days after you told us you want to cancel the purchase. You pay for the return yourself. The item should be in the same condition as when you received it. If the item has lost value because you have handled it more than needed to inspect it, we may deduct the loss in value.
8. Delay
If the item does not arrive at the agreed time, and this is not your fault, you can withhold payment, require us to deliver, cancel the purchase if the delay is significant, and claim compensation for losses under the Consumer Purchases Act.
9. Defects and complaints
If there is something wrong with the item, you must tell us within a reasonable time after you discovered the defect. The deadline is in any case two years after you received the item. You can then require repair, replacement, a price reduction or cancellation of the purchase under the Consumer Purchases Act.
10. Personal data
To deliver your order we use your name, address, phone number and email address from Vipps. This information is only used to process and deliver the order, and for accounting as required by the Norwegian Bookkeeping Act. We only share it with those needed to complete the purchase, such as Vipps and Posten. You can ask to see or delete your information by sending us an email.
11. Dispute resolution
Complaints should be sent to us first, and we will try to find a solution together with you. If we cannot agree, you can contact the Norwegian Consumer Council (Forbrukerrådet) for mediation.
